Terms of service
The terms for using offerpage to send offers and to accept them.
Draft. These terms are a placeholder until offerpage launches and haven't been reviewed by a lawyer. They aren't in force yet, and the words in [brackets] are still to be filled in.
1. Who we are
offerpage is run by [company name], [address] ("offerpage", "we"). You can reach us at [contact email].
2. What offerpage does
offerpage lets a business write an offer, send its client a private link to it, and record the client's acceptance, decline or questions. offerpage provides the tool; the offer, and any agreement that comes from accepting it, is between the business and its client. We aren't a party to it.
3. Accounts
You need an account to send offers. Keep your password to yourself and tell us if you think someone else has used your account. You're responsible for what's done with it, and for the people you invite to your business's team.
4. Your offers
You own what you write. You give us permission to store it, show it to the people you send it to, and email it on your behalf, only to run offerpage. You're responsible for your offers being accurate, lawful and yours to make.
5. Acceptable use
Don't use offerpage to send offers you aren't entitled to make, to impersonate someone, to mislead or defraud anyone, or to send messages people didn't expect from you. We may limit how many emails an account sends, and we may suspend accounts or take offers offline that break these rules or that are reported to us as abusive.
6. Accepting an offer
If you're a client accepting an offer: typing your name and ticking the box records your acceptance of that offer, its terms and the exact version shown to you, along with the time, your email address, your IP address and your browser. A signed copy is kept for you and the business. Questions about the offer itself are for the business that sent it.
7. Availability and changes
We work to keep offerpage running but don't promise it will always be available or free of errors. We may change or stop features, and we'll update these terms when we do; if a change matters, we'll tell account holders before it takes effect.
8. Liability
[To be written with legal advice: limits of liability, and the warranties offerpage does and doesn't give.]
9. Ending
You can stop using offerpage at any time. We may end or suspend an account that breaks these terms. Signed copies of accepted offers are kept as described in the privacy policy.
10. Law
[Governing law and where disputes are heard.]
